But for now, this is very good news<br \/>\n","posted":"June 4th, 2025"},{"wins_id":"10","title":"Amalgamated Transit Union, Local 1587 v Metrolinx - Cannabis Ban","state":"WIN","body":"On February 21, 2025, the Ontario Grievance Settlement Board (the \u201cGSB\u201d) issued an important decision in favour of ATU, Local 1587 with respect to Metrolinx\u2019s Fitness for Duty Policy (the \u201cFFD Policy\u201d). Local 1587 grieved that the ban on use of recreational cannabis was unreasonable, and, in two individual grievances, that Metrolinx had discriminated against two workers by refusing to engages with the accommodation of their use of medical cannabis.<br \/>\nThe GSB decided the following:<br \/>\n\u2022\tMetrolinx\u2019s complete ban on the use of off-duty recreational cannabis by employees in designated safety-sensitive positions was an unreasonable exercise of Metrolinx\u2019s management rights. <br \/>\n\u2022\tMetrolinx did not establish that a ban on off-duty cannabis was necessary to enhance safety, that it had failed to consider less intrusive ways to reach its safety objectives, and  that it had not given proper weight to employee privacy interests. <br \/>\n\u2022\tThe ban infringed on employees\u2019 personal privacy in two ways: (1) through the use of drug testing to enforce the ban and (2) by imposing standards of conduct on employees in their personal lives without a sufficient connection to the workplace. <br \/>\n\u2022\tMetrolinx\u2019s medical expert witness was unreliable and an advocate for Metrolinx. On all points where there was a difference of opinion, the GSB preferred the Union\u2019s expert\u2019s evidence.<br \/>\n\u2022\tIn its application of the FFD Policy, Metrolinx had also imposed a complete ban on the use of medical cannabis by employees in designated safety-sensitive positions, and had discriminated against ATU, Local 1587 members who use medical cannabis to treat their disabilities. <br \/>\n\u2022\tIn the case of two individual grievors, Metrolinx had failed in its duty to accommodate, as it had not conducted any individualized assessments to determine what work they were capable of performing while treating their disabilities with medical cannabis.
